I’ve been doing this for 21 years, and Earl’s story is one of the most memorable probate situations I’ve ever been involved with. Earl gave me permission to share the details, and I think every homeowner in Dallas-Fort Worth needs to hear it, because the mistakes his family made after he passed are the same ones I see families make over and over again.
Earl was a lifelong Fort Worth resident who lived in Haltom City. He did things his own way. He didn’t trust banks, so he kept his cash in coffee cans. He didn’t trust doctors, so he treated every ailment with hot tea and a brisket sandwich. He didn’t trust lawyers either, because he figured why pay someone in a suit to write down what he already knew. So Earl never made a proper will. When he passed away at 81, his three kids were left with a house, $412 in a coffee can, a Dale Earnhardt card, and absolutely zero legal documentation about what was supposed to happen next.
What followed was chaos. Donna, Ray, and Kevin tore the house apart looking for a will, checking everywhere from the violin cabinet to the Bible to the parrot’s cage. What they eventually found was a piece of notebook paper, folded in thirds and stained with barbecue sauce, that read “I, Earl, leave my house to Ray because he stayed.” One signature, no date, no witnesses. Texas does recognize handwritten wills, but nobody could prove the smudged, faded note was actually in Earl’s handwriting, and that one document set off a four-month ordeal that included a collapsed home sale, a title company that couldn’t insure the deal, and more than a few arguments between three siblings who couldn’t agree on anything.
There’s also a parrot named Gerald who, by the end of all this, had learned to say “call a lawyer.” I’m not making that up. I couldn’t if I tried.
I got involved after the family’s first attempt to sell fell apart at the title company, and what Earl’s family went through is one of the clearest lessons I can give you about what happens when there’s no valid will, how Texas intestacy law actually works, and why none of this ever resolves itself without the court getting involved.
